These Terms of Service govern your use of level-up-adventures.com — the operating-company website for Level Up Adventures, LLC. This is a static informational page. By visiting it, you agree to the terms below. PIC Pro and any other product operated under this LLC have their own separate Terms; those products' Terms control any use of those products.

§ 01What this site is

level-up-adventures.com is an informational and editorial site describing Level Up Adventures, LLCand the products it operates, and publishing family-travel editorial content. It is not a platform, an account-based application, or a transactional surface — there is nothing to purchase here and no user-generated content. The site has two interactive elements: (1) an outbound mailto: link to our support address and (2) an optional newsletter signup at the foot of each blog post that asks for an email address so we can deliver Theme Park Pulse, our weekly editorial digest. See our Privacy Policy for the data flow on that signup, and § 12 below for the newsletter terms.

§ 02Acceptable use

You may freely view this page, link to it, screenshot it, and reference it for any lawful purpose. You agree not to:

• Use automated tools to scrape, harvest, or download the site at a rate or volume that materially burdens our hosting infrastructure.
• Misrepresent the relationship between yourself and Level Up Adventures, LLC, or imply an affiliation, partnership, sponsorship, or endorsement that does not exist.
• Frame, mirror, or rehost the site in a way designed to deceive visitors about its origin.
• Probe, scan, or test the vulnerability of the site without prior written permission.
• Use the site or its content in violation of any applicable law.

§ 03No warranties on accuracy

We try to keep the information on this page current and correct. We make no warranty, express or implied, that any statement here — including descriptions of products, status indicators, contact details, or external links — is accurate, complete, or up to date at the moment you read it. The site is provided "as is" and "as available."

§ 04Other products and publications operated under this LLC

References on this site to PIC Pro, ApexView, the Level Up Adventuresfamily-travel publication, the publication's YouTube channel, or any other product describe properties operated by Level Up Adventures, LLC. Some of those properties are governed by their own separate Terms; this Terms of Service governs only level-up-adventures.com and the editorial content published on it (the blog, the about pages, and these legal documents).

• PIC Pro — pic-pro.app/terms governs use of the PIC Pro product. Different rules apply there.
• ApexView— a separate non-commercial, invite-only F1 race-day application. Level Up Adventures, LLChosts its supporting infrastructure on this site's servers. Terms for ApexView (when published) will live alongside the app's own documentation.
• YouTube channel— the publication's YouTube channel is hosted on YouTube and is governed by YouTube's Terms of Service for viewers. Any video we embed on this site is loaded from youtube-nocookie.com; pressing play subjects you to YouTube's own terms.

If you are using or evaluating one of those properties, the property's own Terms of Service is the controlling document for that property — not this one.

§ 05Intellectual property

The name Level Up Adventures, LLC and the brand names used for properties operated under this LLC (including but not limited to PIC Pro, Level Up Adventures as a family-travel publication, Elite99Gaming, and ApexView) are used in commerce by Level Up Adventures, LLC. None of these marks are currently registered with the United States Patent and Trademark Office; any rights asserted in them are common-law rights arising from use in commerce.

Associated logos, the layout, copy, and design of this site are owned by Level Up Adventures, LLC, except where third-party material is identifiable as such. Nothing on this page should be interpreted as granting you a license to those marks, brand names, or copyrighted materials beyond ordinary nominative-fair-use reference.

§ 06External links

This site links to third-party websites (such as pic-pro.app, vercel.com, and others). We do not control those sites and we are not responsible for their content, terms, or privacy practices. A link from this site is not an endorsement.

§ 07Limitation of liability

To the fullest extent permitted by law, Level Up Adventures, LLC disclaims all liability for any direct, indirect, incidental, consequential, or special damages arising from your access to or use of this informational site, including but not limited to damages from reliance on any information presented here. Your sole remedy if you are dissatisfied with this site is to stop using it.

§ 08Indemnification

You agree to indemnify and hold harmless Level Up Adventures, LLC and its agents from any claim arising out of your misuse of this site in violation of these Terms.

§ 09Governing law and venue

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute arising from or related to these Terms or your use of this site shall be brought exclusively in the state or federal courts located in Douglas County, Colorado, and you consent to personal jurisdiction in those courts. Disputes about a specific product (such as PIC Pro) are governed by that product's own Terms of Service, which may include separate dispute-resolution mechanisms.

§ 10Changes to these Terms

We may update these Terms from time to time. The Last updated date at the top reflects the current version. By continuing to use the site after a change, you accept the updated Terms.

§ 11Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision shall be reformed only to the extent needed to make it enforceable.

§ 12Theme Park Pulse newsletter

If you sign up via the form at the foot of any blog post, you are subscribing to Theme Park Pulse— a free, editorial digest about US theme parks. Submitting the form indicates your consent to receive that newsletter at the email address you provided.

• Cadence. The newsletter is published on a roughly weekly cadence. We may pause, skip, or change cadence at our discretion (e.g., during travel, off-season, or editorial reorganization). Subscribing does not entitle you to any specific delivery schedule.
• Confirmation email. Immediately after you sign up, our email service (Resend) sends a one-time confirmation message from pulse@level-up-adventures.com to the address you provided. If you did not request this, you can ignore the email; we do not double-send.
• Unsubscribe.Every newsletter email carries a one-click unsubscribe link (and the native “Unsubscribe” control your mail app shows); using it removes you from the list immediately. You can also email support@level-up-adventures.com directly.
• Content is editorial, not advice.The newsletter is editorial commentary about theme parks and family travel. It is shared in good faith, current as of the publication date of each issue, and is not booking, travel-agency, legal, financial, medical, or accessibility advice. Conditions, prices, closures, and event timing change frequently; you should verify anything time-sensitive on the operator's own channels before acting on it.
• No transfer or resale. Your subscription is personal. Do not sign up other people without their consent, and do not forward Pulse content for commercial redistribution without permission.
• Termination.We may discontinue the newsletter entirely, or remove an individual subscriber, at our discretion — for example, in the case of abuse of the signup form, repeated bounces, or spam complaints.

The data flow for the signup form — including the role of Resend (storage and delivery) and Cloudflare Turnstile (bot-protection challenge) — is described in our Privacy Policy § 04.

§ 13Affiliate relationships and FTC disclosure

Level Up Adventures, LLC participates in affiliate programs with Amazon Associates, AWIN, Partnerize / Expedia Group, Viator, and CJ Affiliate (Commission Junction). When you click an affiliate link on a blog post and make a qualifying purchase, we earn a commission at no additional cost to you. See our Privacy Policy for the data flow and the list of affiliate networks involved.

Posts that include affiliate links carry a footer disclosure consistent with FTC 16 CFR Part 255 (“Guides Concerning the Use of Endorsements and Testimonials in Advertising”). Editorial coverage on this site is independent — we do not accept payment to promote specific destinations or products, and the presence of an affiliate link does not influence our editorial judgment.

Information on the blog is editorial, not advice.Content on this site, including in blog posts, is shared in good faith and is current as of the publication date of each post. Conditions, prices, availability, and merchant-program details change frequently.
